Cedar Fest Sentencing Update

 
EAST LANSING, Mich. – Michael Ray Banish, a 23-year-old Shelby Township man convicted of obstructing, hindering and resisting a police officer during Cedar Fest, was sentenced to 20 days in Ingham County Jail. Kyle Leppek, a 20-year-old Comstock Park man convicted of obstructing, hindering and resisting a police officer during Cedar Fest, had his sentence delayed until May 8.

Banish entered a plea of guilty to the misdemeanor offense and his sentence was imposed by East Lansing 54-B District Court Judge David L. Jordon on Sept. 10. In addition to his jail sentence, Banish was put on probation for two years and ordered to pay $2,214.40, in fines, costs and assessments, including $1,074.40 in restitution for expenses incurred by the City of East Lansing, expenses incurred by assisting agencies and damage to private property during the riot.

Banish was ordered to complete 40 hours of community service. Jordon also prohibited Banish from entering any Michigan public community college, college or university campus for a period of one year.

Leppek was convicted by a jury of the misdemeanor offense and his sentence was delayed until May 8 by East Lansing 54-B District Court Judge Richard Ball.

Prior to his sentencing, Leppek is required to complete a substance abuse treatment program, complete 40 hours of community service, refrain from using or consuming alcohol or illegal drugs and must submit to random breath tests to confirm his abstinence from alcohol and drugs. A judge may then take into account Leppek’s compliance with these conditions before a final sentence is imposed.

Leppek served eight days in jail prior to trial, when the court found he had violated a bond condition prohibiting him from consuming alcohol.
